Definitions
The following definitions apply throughout these Terms and Conditions:
"BLA" / "Us" / "We" / "Our" means Best Life Adventures Pty Ltd ABN 53 610 989 127.
"You" / "Your" / "Participant" means the person(s) who book and/or participate in a trip or event with BLA.
"Booking Fee" means the non-refundable deposit required to secure your place on a trip or event, generally 20% of the total trip price or as otherwise stated by BLA. This fee constitutes a genuine pre-estimate of BLA's administrative and organisational costs and is not a penalty.
"Unrecoverable Costs" means all costs incurred by BLA that cannot be recovered from third-party suppliers following a cancellation, including but not limited to: supplier deposits, permit fees, guide and crew engagement costs, expedition planning and administration costs, marketing costs directly attributable to the trip, and BLA staff time reasonably incurred in organising the expedition.
"Force Majeure Event" has the meaning given in clause 9.
"Minimum Number" means the minimum number of paying participants required for BLA to operate a trip or event viably, as published on BLA's booking platform or communicated to you at the time of booking.
"Writing" / "In Writing" means communication by email between ben@bestlifeadventures.com and the email address you registered at the time of booking.
"ACL" means the Australian Consumer Law as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
1. Declaration and Agreement
1.1 By making a booking with BLA, you acknowledge that you have read and understood these Terms and Conditions.
1.2 By booking with BLA, you accept:
1.2.1 These Terms and Conditions in their entirety.
1.2.2 The terms and conditions contained in the specific Expedition Information Kit for your trip, along with the associated risks and demands.
1.2.3 That you have had the opportunity to seek independent legal advice prior to confirming your booking.
1.3 BLA relies on your declaration under this clause in accepting your request to participate in the Activities.
1.4 Any variation to these Terms and Conditions is only effective if made in writing and signed by an authorised officer of BLA.
1.5 You may accept these Terms and Conditions by:
Selecting the "I agree" option on BLA's booking platform at youli.io/i/best-life-adventures;
Signing a Participant Booking and Waiver Form; or
Making a deposit or payment toward the booking.
1.6 These Terms and Conditions constitute the entire agreement between you and BLA and supersede all prior representations, agreements, and understandings.
2. Validity
2.1 Prices and itineraries published prior to 1 April 2026 are indicative only. Current pricing is available on BLA's booking platform.
2.2 BLA endeavours to ensure all published information is accurate at the time of publication. Changes beyond BLA's control (including to prices, itineraries, service standards, or expedition content) may occur. Surcharges may apply in accordance with clause 5.
2.3 BLA cannot be held responsible for printing or typographical errors, or errors arising from unforeseen circumstances.
3. Booking Fee
3.1 A Booking Fee of not less than 20% of the total trip price is required to secure your booking, unless otherwise stated in writing by BLA. The Booking Fee is non-refundable and non-transferable.
3.2 You acknowledge and agree that the Booking Fee is a genuine pre-estimate of the costs BLA incurs in processing, administering, and organising your booking, including staff time, supplier engagement, permit applications, and expedition planning. It is not a penalty.
3.3 BLA may, at its sole discretion, require a greater or lesser Booking Fee for particular trips or events.
3.4 By paying the Booking Fee, you agree it will be applied toward the administrative and organisational aspects of your trip and is therefore non-refundable in all circumstances, including where BLA cancels the trip due to the Minimum Number not being reached (see clause 9).
3.5 All expedition prices are quoted in Australian Dollars (unless clearly stated otherwise on the product page), include GST and compulsory taxes where applicable, and may supersede previously advertised prices. Prices are subject to change without notice. Please verify the exact price and currency at the time of registering.
3.6 Where airfares are included, they are based on economy class on the most direct route and are subject to availability and government taxes. Airline schedules are subject to change. Any additional costs arising from schedule changes — including overnight accommodation and transfers — are at your expense.
4. Acceptance of Booking and Final Payments
4.1 Your booking is confirmed once you have completed registration on BLA's booking platform and paid the Booking Fee within 7 days of registration. A confirmation receipt will be sent to your nominated email.
4.2 BLA may, at its sole discretion, decline to accept your registration at any time, including after receipt of the Booking Fee. In such circumstances, the Booking Fee will be refunded in full.
4.3 Final payment deadlines are published on your Expedition Dashboard at youli.io/i/best-life-adventures:
Domestic (Australian) trips: balance due no later than 60 days before departure.
International trips: balance due no later than 90 days before departure.
4.4 If the balance is not received by the due date, BLA reserves the right to treat your booking as cancelled and all deposited monies will be forfeited in accordance with clause 7.
5. Prices and Surcharges
5.1 Trip prices are subject to variable and seasonal pricing, which is standard practice in the travel industry. Prices may vary in accordance with demand, currency fluctuations, market conditions, and availability.
5.2 Different participants on the same trip may be charged different prices. If you are satisfied with the price at the time of booking, we recommend paying the total trip price in full to lock in that price and protect against currency fluctuations.
5.3 Reduced pricing or discounts introduced after your deposit has been paid will not apply to your booking.
5.4 If you wish to cancel your booking to take advantage of a lower price, full cancellation conditions under clause 7 apply.
5.5 BLA reserves the right to impose surcharges up to 14 days before departure due to unfavourable changes in exchange rates or supplier costs.
5.6 BLA will absorb surcharges of up to 1% of the total trip price. For surcharges exceeding 1%, BLA will provide written notice.
5.7 If any surcharge results in an increase of more than 10% of the total trip price, you may cancel the booking by providing BLA with clear written notice within 5 business days of receiving BLA's surcharge notification. If you do not cancel within that period, you agree to pay the surcharge.
5.8 If you cancel under clause 5.7, your Booking Fee is forfeited and BLA will refund the remaining balance less any Unrecoverable Costs and administration fees.
5.9 You agree to pay any payment processing surcharges imposed by Stripe, PayPal, or other payment platforms. There is no surcharge for direct bank transfers.
5.10 You acknowledge and agree that:
5.10.1 The Booking Fee is non-refundable.
5.10.2 Payment for domestic expeditions must be received no later than 60 days prior to departure.
5.10.3 Payment for international expeditions must be received no later than 90 days prior to departure.
5.10.4 Airfares, shipping, and rail fares are non-refundable and non-transferable unless otherwise communicated in writing by BLA.
5.10.5 Single-use rooms attract a single supplement fee. BLA does not offer a 'willing to share' service.
5.10.6 Where a booking is made as a twin share and one participant cancels, the remaining participant agrees to pay the applicable single supplement.
5.10.7 Twin share prices are per person unless otherwise stated.
6. Your Details
6.1 To confirm your travel arrangements, you must provide all requested personal details within 14 days of paying your Booking Fee.
6.2 Required details include, but are not limited to:
Full name as per passport;
Date of birth;
Nationality;
Passport number, issue date, and expiry date;
Any pre-existing medical conditions that may affect your ability to complete your travel arrangements.
6.3 All participants are required to complete a Participant Information Form. Where required, this must include medical sign-off from a registered Australian General Practitioner. Failure to provide requested details may result in additional charges or non-refundable cancellation of your booking.
7. Cancellation by You
7.1 You may cancel your booking by providing BLA with written notice. Cancellation is effective from the date written notice is received by BLA.
7.2 Subject to clause 7.4, if you cancel before the Balance Due Date as shown on your Expedition Dashboard, you may elect to:
Transfer the amount paid to an alternate departure date of the same trip (a Booking Transfer Fee of AU$200 per person applies);
Transfer the value of your booking to another BLA trip published on bestlifeadventures.com, with a start date within 12 months of the original departure date (a Booking Transfer Fee of AU$200 per person applies); or
Request a cash refund, subject to the cancellation fee schedule in clause 7.3, which must be requested within 12 months of the original departure date.
7.3 The following cancellation fee schedule applies, calculated as a percentage of the total trip price:

7.4 After the Balance Due Date, all payments are non-refundable except as may be required under the ACL.
7.5 BLA strongly recommends purchasing comprehensive travel insurance within 7 days of paying your Booking Fee, to protect against the need to cancel your booking.
8. No Refunds for Unused Services
8.1 No refunds or discounts will be provided for missed or unused services, including where you voluntarily or involuntarily terminate your participation in a trip, whether as a result of illness, a family bereavement, late arrival, or any other reason.
8.2 You agree that having adequate travel insurance (as required under clause 18) protects you in the event of such circumstances.
9. Cancellation by BLA
9.1 General Right to Cancel
BLA reserves the right to cancel any trip or your participation in a trip at any time prior to departure due to:
(a) A Force Majeure Event, meaning any event beyond the reasonable control of BLA, including but not limited to: acts of God; war; civil commotion; riot; blockade or embargo; fire; explosion; breakdown; industrial dispute; earthquake; epidemic, pandemic or other public health emergency; flood; windstorm or other extreme weather; failure of supply chains; passage of any law, regulation, ordinance, demand or requirement of any government authority; or failure of third-party suppliers to perform their obligations; or
(b) The Minimum Number of paying participants not being reached by the date specified on BLA's booking platform or in BLA's written communications (see clause 9.2 below); or
(c) BLA determining, in its reasonable opinion, that you do not have the requisite fitness, skills, or ability to safely participate in the Activities.
9.2 Cancellation Due to Minimum Numbers Not Being Reached
9.2.1 Each trip or event is subject to a Minimum Number of paying participants. BLA publishes or communicates the Minimum Number for each trip on its booking platform or in writing at the time of booking. By booking, you acknowledge and accept this condition.
9.2.2 BLA will make commercially reasonable efforts to fill available places prior to cancelling a trip for failure to reach the Minimum Number. BLA will notify you in writing as soon as practicable if a trip is at risk of cancellation for this reason.
9.2.3 Where BLA cancels a trip because the Minimum Number has not been reached:
(a) BLA will retain the Booking Fee in full. You acknowledge and agree that the Booking Fee represents a genuine pre-estimate of BLA's non-recoverable costs in planning, organising, promoting, and administering the trip, including but not limited to staff time, supplier engagements, permit and access applications, route planning, guide and crew commitments, and marketing expenditure directly attributable to the trip. This retention is not a penalty.
(b) BLA will retain any further Unrecoverable Costs beyond the Booking Fee that BLA has actually incurred and cannot recover from third-party suppliers. BLA will provide you with a written itemised statement of such Unrecoverable Costs within 14 days of cancellation.
(c) BLA will refund the balance of monies paid by you, being the total amount paid less the Booking Fee and any Unrecoverable Costs notified under clause 9.2.3(b), within 30 days of cancellation.
9.2.4 In addition to the refund (if any) under clause 9.2.3(c), BLA will offer you the choice of:
Transferring the value of your Booking Fee to an alternate departure date for the same or a comparable BLA trip, with a start date within 18 months of the original departure date; or
Receiving a credit note for the value of the Booking Fee, redeemable against any BLA trip within 18 months of the original departure date.
9.2.5 BLA will use reasonable endeavours to notify participants of a Minimum Number cancellation no later than 60 days before the scheduled departure date for international trips and 30 days before for domestic trips. BLA will use its best efforts to provide earlier notification wherever possible.
9.2.6 You acknowledge and agree that the retention of the Booking Fee and Unrecoverable Costs under this clause is a legitimate protection of BLA's commercial interests, has been clearly disclosed to you prior to booking, and reflects the genuine costs BLA incurs in bringing each expedition to market. You are encouraged to obtain travel insurance that covers trip cancellation by the operator for failure to reach minimum numbers.
9.3 Cancellation Due to Force Majeure
9.3.1 Where BLA cancels or postpones a trip due to a Force Majeure Event, BLA will offer you the choice of:
Transferring the amount paid to an alternate departure date for the same trip;
Transferring the value of your booking to another BLA trip published on bestlifeadventures.com, with a start date within 18 months of the original departure date; or
A refund of monies paid, less the Booking Fee and any Unrecoverable Costs, to be requested in writing within 12 months of the original departure date.
9.3.2 You acknowledge and agree that BLA is not responsible for any incidental expenses you have incurred as a result of your booking, including visas, vaccinations, travel insurance excess, or non-refundable flights.
9.3.3 BLA may postpone or cancel a trip due to travel restrictions imposed by national, state, or local governments. A decision on whether the trip will proceed will be made based on the most current information available no less than 30 days before departure.
9.4 COVID-19 and Pandemic Events
9.4.1 Where COVID-19, or any other pandemic or epidemic, prevents BLA from operating a trip, requiring cancellation or postponement, the total value of any refund will take into account the non-refundable Booking Fee, any payments already made by BLA to suppliers, contractors, or sub-contractors, and any Unrecoverable Costs, in accordance with their applicable cancellation policies.
9.4.2 You acknowledge that global health events, changing government restrictions, and the evolving nature of pandemics create risks beyond BLA's control. You agree that it is your responsibility to maintain adequate travel insurance to protect against these risks.
10. Booking Amendments
10.1 If you wish to transfer to a different trip departure or transfer your booking to a third party, you must notify BLA in writing at least 60 days prior to departure. The new trip must commence within 12 months of the original trip start date.
10.2 An amendment fee of AU$200 per person per change applies (in addition to any charges levied by hotels, ground operators, or airlines).
10.3 If you notify BLA less than 60 days prior to departure, the cancellation policy in clause 7 applies.
10.4 Transfers to a third party are only permitted where the transferee meets all trip requirements and are subject to a surcharge of up to 5% at BLA's sole discretion.
10.5 No amendments are permitted within 14 days of departure.
11. Inclusions
11.1 The trip land price includes:
All accommodation as listed in the Expedition Information Kit or your Expedition Dashboard;
All transport as listed in the Expedition Information Kit or your Expedition Dashboard;
Sightseeing and meals as listed in the Expedition Information Kit or your Expedition Dashboard;
Services of a group leader as described in the Expedition Information Kit or your Expedition Dashboard.
12. Exclusions
12.1 The trip land price does not include:
International or internal flights, unless specified;
Airport transfers, taxes, and excess baggage charges, unless specified;
Meals other than those specified in the Expedition Information Kit;
Visa and passport fees;
Travel insurance;
Optional activities and personal expenses.
12.2 Airfares included in packages are economy class. BLA cannot be responsible for seating allocation.
12.3 Luggage restrictions vary by trip and destination. As a general guide, checked luggage on international flights should not exceed 23 kilograms per person. Your Expedition Information Kit will specify applicable limits.
12.4 All accommodation is twin share unless otherwise stated. Single rooms may be available for an additional fee; however, BLA does not guarantee the availability of single rooms on any expedition.
12.5 BLA may, at its sole discretion, change accommodation location, style, or quality without notice, subject to providing accommodation of a comparable standard.
13. Special Dietary Requirements
13.1 You must advise BLA of any special dietary requirements at least 14 days before departure. Requests will be accommodated where possible, but BLA cannot guarantee the availability of special meal types.
13.2 If special dietary requirements incur additional costs, BLA reserves the right to pass those costs on to you.
14. Age and Health Requirements
14.1 Minimum Age: The minimum age for most BLA trips is 15 years at the time of travel. All participants under 18 must be accompanied by a legal guardian or by an adult escort (aged 18 or over) appointed by their legal guardian.
14.1.1 The legal guardian or their designated escort is responsible for the day-to-day care of participants under 18. A delegation authority document must be completed and signed if a legal guardian appoints an escort in their place.
14.1.2 BLA cannot guarantee triple or adjoining rooms for families. Accompanying adults may be required to share rooms with other group members on a twin-share basis.
14.2 Maximum Age: BLA has no upper age limit for most trips; however, participants must be suitably fit to allow full participation. BLA can provide details of physical fitness requirements, but is not a medical authority.
14.3 You must obtain comprehensive medical advice from a registered Australian General Practitioner at least two months prior to departure regarding health requirements for your destination.
15. Physical Fitness
15.1 It is your responsibility to research and understand the physical demands of your trip and to achieve the necessary level of fitness and preparedness.
15.2 You confirm that you have independently assessed the Activities and that you are physically fit to participate in all activities proposed.
15.3 You warrant to BLA that:
15.3.1 You have obtained advice from a registered Australian General Practitioner regarding the trip and have not been advised against participating.
15.3.2 You have disclosed to BLA every pre-existing medical or physical condition of which you are aware, or ought reasonably to know, that is relevant to safely participating in the trip.
15.3.3 You are in good physical and mental health at the time of booking.
15.3.4 You are fit enough to undertake all included activities without risk to your health.
15.3.5 You will notify BLA immediately, by email to ben@bestlifeadventures.com, of any adverse change in your health or fitness that may impact your ability to participate.
15.3.6 BLA may disclose your medical information to any party it reasonably considers necessary for the safe operation of the trip.
15.3.7 BLA may exclude you from a trip at its sole discretion. The obligation to disclose continues from the time of booking through to the conclusion of the trip.
15.3.8 You have taken necessary precautions to immunise and/or vaccinate for your destination.
15.4 BLA uses the following physical activity ratings. By booking a trip with a specified rating, you confirm that you meet the applicable minimum physical requirements:
Rating 1 – Easy: Ability to participate in relaxed-pace guided walking; mostly level ground; occasional stairs or inclines; standing up to 10 minutes; independent boarding and alighting of transport; management of own luggage.
Rating 2 – Moderate: Ability to participate in walking/biking/kayaking with rest breaks at minimum every 10 minutes; uneven terrain including bush tracks and soft sand; standing for 15 minutes; managing own luggage.
Rating 3 – Active: Ability to participate in walking/biking/kayaking/snowshoe or equivalent activity without stopping for up to 30 minutes; walking up stairs or inclines without stopping; traversing uneven ground, creek crossings, and soft sand; managing own luggage.
Rating 4 – Highly Active: Ability to sustain physical activity for up to 8 hours per day; confident navigation of inclines, declines, and varied terrain; ability to carry a loaded daypack in addition to managing own luggage; living an active lifestyle as a baseline.
16. Medical Treatment, Medical Conditions, and Evacuation
16.1 On international expeditions, you must carry at all times a letter from your registered General Practitioner or a copy of your prescription, confirming your entitlement to carry any required medication.
16.2 You consent to receiving any first aid or emergency medical treatment that BLA reasonably considers necessary during or after the Activities. You must disclose all relevant medical conditions to BLA in writing at the time of booking. Failure to disclose may result in refusal of travel without refund.
16.3 You acknowledge that medical facilities and standards vary significantly between countries. BLA makes no warranty regarding the availability or standard of medical treatment at any destination.
16.4 BLA will not be liable for any injury, illness, or emotional condition suffered by you before, during, or after the trip.
17. Passports, Visas, and Travel Documentation
17.1 You must carry a valid passport and obtain all required visas, permits, and certificates for the countries you will visit.
17.2 Your passport must be valid for at least 6 months beyond your return date. It is your responsibility to ensure you hold the correct travel documentation. Refer to your Expedition Information Kit for specific requirements.
17.3 BLA accepts no responsibility if you are refused entry to any country due to inadequate travel documentation.
18. Travel Insurance
18.1 Adequate and valid travel insurance is mandatory for all international trips. Travel insurance is strongly recommended for all domestic trips. Your policy must be purchased within 7 days of making your first payment to BLA.
18.2 Your travel insurance policy must cover, at a minimum:
All activities specified in your Expedition Information Kit (which may include trekking to 6,000m, kayaking, mountain biking, and other adventure activities);
Medical expenses and death-related expenses, including those arising from pre-existing medical conditions;
Emergency evacuation and repatriation, including helicopter rescue and air ambulance;
Minimum coverage of US$200,000 per category;
Trip cancellation and curtailment, including cancellation due to failure of minimum group numbers;
Personal liability;
Loss of luggage and personal effects.
18.3 You must provide your policy number and your insurer's 24-hour emergency contact number before or on the first day of your trip. You will not be permitted to join the trip without these details.
18.4 BLA reserves the right to cancel or suspend your participation in the trip, without refund, if you are unable to produce proof of adequate insurance when requested.
18.5 You agree to obtain travel insurance from a certified and registered insurance broker. Any broker or agency referred to by BLA may not be certified to provide cover meeting your specific requirements; it is your responsibility to verify this.
18.6 You acknowledge that the insurance cover you obtain fully covers the scenarios described in these Terms and Conditions.
19. Personal Property
19.1 You have sole responsibility for your personal property throughout the duration of the trip and any associated activities.
20. Flexibility and Itinerary Changes
20.1 The nature of adventure travel requires flexibility. You should allow for alternatives to planned activities, routes, accommodation, and transport.
20.2 Itineraries are representative of the types of activities contemplated. Routes, schedules, amenities, and modes of transport may be altered without prior notice due to local conditions or events beyond BLA's control.
20.3 Before departure: If BLA makes a major itinerary change (defined as a change affecting at least one day in five of the itinerary), BLA will notify you as soon as reasonably practicable. You may then choose to: (a) accept the change; (b) transfer to an alternative BLA expedition; or (c) receive a refund of the land component only.
20.4 After departure: BLA reserves the right to alter the itinerary after departure due to circumstances outside its control. Any additional costs arising from necessary itinerary changes are at your expense. BLA is not responsible for incidental expenses including visas, vaccinations, or non-refundable flights.
21. Authority on Expedition and Code of Conduct
21.1 Group trips are led by a BLA group leader whose decisions are final on all matters affecting the safety or wellbeing of participants and staff.
21.2 If you fail to comply with a group leader's decision, or interfere with the wellbeing or safe operation of the group, the group leader may direct you to leave the trip immediately, with no right to a refund.
21.3 BLA may exclude any participant from a trip, without refund, where that participant:
Is incapable of self-care without a dedicated minder;
Is unable to meet the physical or logistical requirements of the expedition;
Fails to comply with reasonable instructions from BLA staff;
Engages in illegal, offensive, or disruptive behaviour;
Poses a risk to themselves or other participants;
Acts in a manner objectionable to other participants or BLA staff.
21.4 Participants who are excluded must disembark at a safe public location. Onward transport is entirely their own responsibility and cost.
21.5 You agree to comply with the laws, customs, foreign exchange regulations, and drug laws of all countries visited, and to travel in accordance with BLA's responsible travel guidelines.
21.6 BLA will not be liable for any costs incurred by you following exclusion from a trip.
22. Voluntary Assumption of Risk
22.1 You voluntarily choose to participate in the trip and the Activities, and you understand that participation involves a real risk of serious injury, death, or property loss from causes including but not limited to: equipment failure, accidents, course or weather conditions, acts of God, travel in remote areas, limited access to medical facilities, and force majeure events.
22.2 BLA uses information from the Australian Government's Smartraveller service and its own operational contacts in assessing whether a trip should proceed. It is also your responsibility to acquaint yourself with all relevant travel advisories for your destination.
22.3 You voluntarily accept all risks arising from your participation in the Activities, including the risk of serious injury or death.
23. Limitation of Liability
23.1 BLA operates as a principal tour organiser and contracts with third-party companies, government agencies, guides, and individuals to assist in running trips. BLA is not responsible for the acts or omissions of those third parties.
23.2 To the maximum extent permitted by the ACL, BLA excludes all liability for any loss, injury, death, or damage suffered by you directly or indirectly in connection with your participation in a trip or any breach of these Terms and Conditions.
23.3 To the extent that any consumer guarantee under the ACL cannot be excluded, BLA's liability is limited to the lesser of:
The cost of re-supplying the relevant services;
The cost of having the relevant services re-supplied; or
A refund of the amount paid by you to BLA in connection with your booking.
23.4 BLA excludes all liability for indirect, consequential, special, punitive, or exemplary loss or damage, including pure economic loss, howsoever caused.
23.5 Nothing in these Terms and Conditions is intended to exclude, restrict, or modify any right or remedy, or any consumer guarantee, that you have under the ACL that cannot be lawfully excluded.
24. Liability Release and Indemnity
24.1 To the maximum extent permitted by law, you agree to release, discharge, and hold harmless BLA, its employees, officers, directors, shareholders, agents, contractors, volunteers, affiliated entities, successors, and assigns from all claims, demands, and proceedings arising from your participation in the Activities, including claims arising from negligence.
24.2 This release and indemnity is ongoing and binds your heirs, executors, personal representatives, and assigns.
25. Equipment and Facilities Inspection
25.1 Before participating in any Activity, you agree to independently inspect relevant equipment and facilities.
25.2 You must immediately advise BLA of any unsafe condition observed, and may decline to participate until that condition is remedied.
25.3 BLA takes reasonable safety precautions as a service to participants, but does not warrant that those precautions guarantee safety.
26. Force Majeure — Limitation of Liability
26.1 BLA will not be liable in contract, tort, statute, or restitution for any loss, damage, cost, or injury resulting directly or indirectly from a Force Majeure Event, including any cancellation or change to travel arrangements arising from that event.
26.2 For the avoidance of doubt, BLA is not obliged to refund any part of the Booking Fee or purchase price paid where travel arrangements are cancelled or changed due to a Force Majeure Event.
26.3 You acknowledge that global pandemics, extreme weather events, civil unrest, and terrorism represent foreseeable risks beyond BLA's control, and that it is your responsibility to maintain adequate travel insurance to cover those risks.
27. Optional Activities
27.1 Optional activities not included in the trip price do not form part of the trip or this contract.
27.2 BLA is not liable for any optional activities, even where a group leader or local representative assists in arranging them. The contract for any such activity is between you and the relevant activity provider.
28. Complaints
28.1 If you have a complaint during your trip, you should inform your group leader or BLA's local representative as soon as possible so that they may attempt to resolve the matter.
28.2 If the matter is not resolved to your satisfaction, any further complaint must be made to BLA in writing within 30 days of the end of the expedition.
29. Dispute Resolution
29.1 The parties agree to attempt to resolve any dispute arising from these Terms and Conditions through good faith negotiation in the first instance.
29.2 If a dispute cannot be resolved by negotiation within 14 days of written notice by either party, the parties agree to refer the dispute to mediation as the prescribed form of alternative dispute resolution (ADR), before commencing proceedings.
29.3 If the dispute is not resolved through mediation, the parties submit to the non-exclusive jurisdiction of the courts of Queensland, Australia.
30. Photography, Filming, and Name/Likeness
30.1 By participating in a BLA trip, you grant BLA and its authorised partners a perpetual, royalty-free, worldwide, irrevocable licence to use photographs or footage of you taken during the trip for promotional, advertising, and reporting purposes, unless restricted by applicable privacy legislation.
30.2 Close-up photographs will not be used without your specific prior consent.
30.3 You consent to BLA using comments from surveys or feedback forms for promotional and marketing purposes.
31. Privacy
31.1 Personal information collected by BLA is used to operate trips and events, and may be used to send you marketing material relating to BLA's trips, events, and offers.
31.2 Your information may be disclosed to BLA's agents, service providers, and suppliers to the extent necessary to operate your trip. BLA otherwise handles your information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
31.3 BLA's Privacy Policy is available at bestlifeadventures.com.
32. Unfair Contract Terms Notice
32.1 BLA's booking terms constitute a standard form contract within the meaning of the ACL. As required by the ACL (as amended by the Treasury Laws Amendment (More Competition, Better Prices) Act 2022 (Cth), effective 9 November 2023), BLA has endeavoured to ensure that no term of this contract is unfair within the meaning of Part 2-3 of the ACL.
32.2 If you believe any term of this contract is unfair, you may contact BLA in writing to discuss the matter. Nothing in this clause limits any rights you may have under the ACL.
33. Severability
33.1 If any term or condition is found to be unenforceable or void by operation of law, that term will be severed or amended to the minimum extent necessary to allow the remaining terms and conditions to continue in full force and effect.
34. Governing Law
34.1 These Terms and Conditions are governed by the laws of Queensland, Australia, and all parties submit to the jurisdiction of the Queensland courts, subject to clause 29.
35. Notifications
35.1 All written communications regarding your booking must be sent by email to info@bestlifeadventures.com. Where these Terms and Conditions refer to "writing" or "written notice", that means communication by email between info@bestlifeadventures.com and the email address you registered at the time of booking.
35.2 BLA will communicate with you via the email address you provided at registration.
36. Further Confirmation
36.1 You acknowledge, confirm, and agree to be bound by these Terms and Conditions. You confirm that you have read and understood this document, that you completed the booking of your own free will, and that BLA did not induce your decision to participate.
36.2 BLA may require you to execute additional documentation confirming your acceptance of these Terms and Conditions prior to or during the trip.
